Terms of Service

1. Who we are

The SiteSmith service is operated by Rosseta Systems sp. z o.o., ul. Zwycięstwa 2, 42-700 Lubliniec, Poland, registered in the Polish National Court Register (KRS) under number 0000482365, NIP (tax ID) 5761576472 ("we", "us"). Contact: michal@sitessmithhq.com. By purchasing through SiteSmith you ("you", "the buyer") agree to these Terms.

2. What the service is

SiteSmith sells pre-built static website files. We review publicly available websites, independently create a rebuilt version, and publish a live preview. You can inspect the complete preview — every page, on any device — before deciding to buy. The purchase is a one-time payment for a download of the website files shown in that preview.

3. What you receive

• A ZIP archive containing the complete website: HTML, CSS and JavaScript files and all image assets, exactly as shown in the preview at the time of purchase;
• A written setup guide (setup-guide.html) covering hosting, editing images, enabling visitor tracking, and how the contact form works;
• A perpetual, non-exclusive license to use, modify, and host the delivered files for the business the website describes (section 8).

Unless bought as the optional add-on in section 11, you do not receive: a domain name, email services, ongoing maintenance, or any service not listed above. Courtesy hosting and the customer panel are described in sections 10 and 11.

4. Purchase, delivery, refunds

Payment is processed by Stripe. After payment you are redirected to a download page; the download link remains available and can be reused if the download is interrupted.

All sales are final once the files have been downloaded. Because the complete website is available for inspection as a live preview before purchase, and because the product is digital goods delivered instantly, no refunds are provided after download. If a technical fault on our side prevents you from downloading at all, contact us and we will deliver the files by other means or refund the payment.

5. No warranty — files are provided "as is"

The website files are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, accuracy of content, or uninterrupted error-free operation. You inspected the preview before buying; what you saw is what you get.

6. No support obligation

The purchase price does not include technical support, maintenance, updates, or modifications. We are under no obligation to provide assistance of any kind after delivery. We may, at our sole discretion, voluntarily answer questions or help — such goodwill assistance does not create any right to, or expectation of, future support.

7. Your responsibilities

• Content review: the rebuilt website was created from your existing public website. You are responsible for reviewing all texts, prices, offers, and contact details for accuracy before publishing, and for the legal compliance of your business content (including privacy and consumer law applicable to you).
• Hosting: after purchase, hosting the website is your responsibility. The guide explains free options.
• Rights in materials: images and texts originating from your own website remain governed by whatever rights you hold in them; we do not warrant third-party rights in materials that were already published on your website.

8. License and ownership

Upon full payment you receive a perpetual, worldwide, non-exclusive license to use, modify, publish, and create derivative works of the delivered files for the business the website describes. Your own business content (texts, photos, trademarks) remains yours. We retain the right to use the general design techniques, code patterns, and know-how to create works for others, and to reference non-confidential aspects of the work in our portfolio.

9. Contact form service

Delivered websites may include a contact form connected to our form-forwarding service (spam filtering and delivery of messages to your email). This service is provided free of charge, on a best-effort basis, as a courtesy: it carries no availability guarantee and may be modified or discontinued at any time. The setup guide explains how to reconnect the form to a provider of your choice at any time.

10. Preview hosting; courtesy hosting

The live preview (including previews hosted on sitessmith.com subdomains) is temporary, provided solely to let you evaluate the work, and may be modified or withdrawn at any time, including after purchase. The product you own is the downloaded files.

Courtesy hosting for first websites. Where the website was created for a business without an existing website (from its social-media profile) and our offer said the site can stay online, we will, after purchase, keep the site hosted at its sitessmith.com subdomain free of charge, on a best-effort basis. This courtesy hosting carries no availability guarantee or SLA, may be modified, migrated, or discontinued with reasonable notice to your contact email, and does not include a custom domain. Your permanent entitlement remains the downloaded files, which you can host anywhere at any time.

11. Optional add-on: your own domain and mailbox

Where offered at checkout or in the customer panel, you may buy a yearly add-on under which we (a) register a domain name of your choosing from the names we propose, in your name, through our accredited registrar OVHcloud, acting as your agent on the authorisation you give at checkout; (b) point the domain at your hosted website; and (c) provide one or more email mailboxes on that domain through OVHcloud's mail service.

• You are the registrant. Your name and contact details are sent to the domain registry and may appear in public WHOIS/RDDS records. The registrar's own terms and ICANN's registrant rights and responsibilities apply to the registration.
• Renewal. The add-on is a yearly subscription: after the first year it renews automatically on each anniversary at the renewal price shown at purchase, charged to the payment card you provided. We email you about a month before each renewal. You can cancel at any time before the renewal date from the customer panel (Manage renewal), in which case the add-on runs to the end of the paid term and then lapses; no refunds are given for a term already charged. If a renewal payment fails and is not resolved, we stop renewing and the domain lapses at the end of its term.
• Leaving. You may transfer the domain to another provider at any time; we unlock it and send the transfer code to your email address free of charge, subject to the registry's transfer lock on newly registered domains.
• Email. Mailboxes are provided on a best-effort basis. Mail passing through them is your data; we act as a processor for it and access it only to operate the service (see the Privacy Policy). Keep your password safe and change it after first sign-in.
• DNS. The panel lets you edit DNS records. Records that keep the website and email working are protected; changes you make to other records are your responsibility.

Customer panel. The panel at panel.sitessmith.com (sign-in by one-time code to the email address you paid with) lets you download your files, edit the site's text, lists and photos, request changes, and manage the domain add-on. It is provided free of charge on a best-effort basis and may be modified with reasonable notice.

12. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or related to the service and the delivered files is limited to the amount you paid. We are not liable for indirect, incidental, or consequential damages, lost profits, or lost data. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights that may apply in your jurisdiction.

13. Governing law

These Terms are governed by the laws of Poland. Disputes will be resolved by the court competent for the seat of Rosseta Systems sp. z o.o., unless mandatory consumer law provides otherwise.

14. Changes

We may update these Terms; the version published at the time of your purchase applies to that purchase.
